Human cognition affects the result of symbolic activity. Evidentiality is a linguistic concept which encodes the source of information and expresses the attitude and confidence of speaker. This paper collects 31 judgments from the Supreme People’s Court (SPC) and local people’s courts in the People’s Republic of China (P.R.C) as the research corpus, and analyzes the evidentiality in four aspects: information source, lingual form, evidential function and speaker’s attitude of the information. It is found in this study that: 1) The (...) information sources are divided into four types as cultural belief, sensory experience, verbal rumor and inferential hypothesis; 2) Lingual form consists of three categories: vocabulary, phrase and compound sentence; 3) Evidentiality in court judgments performs four functions: support with citation, induction with description, paraphrase with less responsibility and summarization with reasoning; 4) The reliability of evidentiality presents a two-tier structure based on different information sources. From the perspective of Peirce’s semiotics, the paper analyzes the judicial practice of court judgments with actual data and proposes some suggestions. (shrink)

En me concentrant sur les écrits de Xuanzang (env. 602–664) et de son disciple Kuiji (632–682), j'examine comment la théorie de la conscience du Yogācāra peut être interprétée comme un récit genré de la non-dualité. Ainsi, le terme «dialectique du Yogācāra» serait employé afin de décrire cette théorie de la non-dualité qui souligne la fluidité et la transformabilité. The phenomenon of knowledge withholding is a vital issue that undermines knowledge sharing and innovation, hinders the development of offline and online organizations. Clarifying the relationship between influencing factors and knowledge withholding is significant to improve the phenomenon of knowledge withholding in offline and online organizations. Few types of research focus on the online virtual academic community and integrate the three factors of knowledge, individual, and environment to research knowledge withholding. To solve the limitation, this research is based on sociology (...) and psychology-related theories. The two dimensions of enabling and inhibition are divided into factors affecting knowledge withholding. An attempt is made to explore the path between the three types of factors influencing knowledge, individual and environment, and knowledge withholding. This study collected data from 616 users in China’s virtual academic community. It used a structural equation model combined with a cross-layer connected neural network to conduct an empirical analysis on the proposed hypothesis. The results found that: in the virtual academic community, knowledge power in the enabling dimension is the main reason for users to form knowledge psychological ownership, which affects users’ knowledge withholding. However, the effect of professional commitment on users’ knowledge psychological ownership is not significant. After SEM-ANN model fitting, the combined inhibitory effect of community privacy protection and community reciprocity on user knowledge withholding in the inhibition dimension is significantly improved. This research has a specific guiding significance for enhancing the knowledge withholding phenomenon of the virtual academic community and creating an excellent academic exchange atmosphere. In her recent book _A Duty to Resist_ (2018), Candice Delmas contends that both beneficiaries and victims of injustices have a duty to resist unjust laws and to try to change them, and proposes several ways of grounding this duty. One of these proposed groundings appeals to considerations of fairness. Delmas holds that anyone who refuses to participate in resisting some injustice, including victims of that injustice, can be accused of free-riding and thus of unfair conduct that violates the duty (...) of fair play, which means that they have a fairness-based duty to resist. In this paper, I critique this attempt to ascribe a duty to resist grounded in considerations of fairness specifically to victims of injustice. Against Delmas, I argue that victims of injustice do not have this fairness-based duty to resist because, unlike the beneficiaries of an injustice, they cannot be considered free-riders when they do not participate in resistance to the injustice. I then discuss additional problematic implications of Delmas’s view, focusing on the issue of victim-blaming, and show how these problems can be avoided. In this way, I hope to contribute to the urgent project of determining who has a duty to resist injustice. (shrink)

According to a historical claim oft-repeated by contemporary epistemologists, the ‘traditional’ conception of knowledge prevailed in Western philosophy prior to the publication in 1963 of Edmund’s Gettier’s famous three-page article ‘Is Justified True Belief Knowledge?’. On this conception, knowledge consists of justified true belief. In this article, I critically consider evidence for and against this historical claim, and conclude with a puzzle concerning its widespread acceptance.

Is time flowing? A-theorists say yes, B-theorists say no. But both take time to be real. It means that B-theorists accept that time might be real, even if lacking a property usually ascribed to it. In this paper, I want to ask what are the different properties usually ascribed to time in order to draw the list of different possible kinds of realism and anti-realism about time. According to a plausible and influential account of perceptual knowledge, the truth-makers of beliefs that constitute perceptual knowledge must feature in the causal explanation of how we acquire those beliefs. However, this account runs into difficulties when it tries to accommodate time perception -- specifically perception of order and duration -- since the features we are apparently tracking in such perception are not causal. The central aim of the paper is to solve this epistemological puzzle. Two strategies are examined. The (...) first strategy locates the causal truth-makers within the psychological mechanism underlying time perception, thus treating facts about time order and duration as mind-dependent. This strategy, however, is problematic. The second strategy modifies the causal account of perceptual knowledge to include a non-causal component in the explanation of belief-acquisition, namely chronometric explanation. Applying this much more satisfactory approach to perceptual knowledge of time, we can preserve the mind-independence of order and duration, but not that of time's flow. (shrink)

We develop a model of ideals-based accountability which we have witnessed at work in several long-thriving family businesses. The owners and managers of these firms eschew individualism and materiality in the pursuit of ethical ideals such as supporting democracy and bettering the human condition. Although accountability is to these ideals, not for outcomes such as profitability or even reputation, IBA has resulted in outstanding reputations for some firms. We characterize IBA according to its missions, leadership, culture, and stakeholder relationships. We (...) also contrast it with traditional forms of accountability and differentiate IBA from related stakeholder, stewardship, and CSR perspectives. Finally, we examine its manifestations within five long-lived family enterprises, in the process generating propositions to advance the concept. (shrink)

An ingenious argument – we may call it the Argument from Excuse – purports to show that the Standard View of Ignorance is false and the New View of Ignorance is true. On the former, ignorance is lack of knowledge; on the latter, ignorance is lack of true belief. I defend the Standard View by arguing that the Argument from Excuse is unsound. I also argue that an implication of my case is that Factual Ignorance Thesis (FIT) is false. According (...) to FIT, whenever an agent A acts from factual ignorance, A is morally blameworthy (culpable) for the act only if A is morally blameworthy (culpable) for the ignorance from which A acts. Par son rôle déterminant dans la réussite scolaire et professionnelle, ainsi que dans l’insertion sociale, l’apprentissage de l’orthographe lexicale représente un défi majeur pour les élèves du primaire. Dans ce contexte, nombreux sont les enseignants, orthophonistes et chercheurs à s’intéresser à la question des outils utiles à son enseignement et à son apprentissage, et à avoir recours notamment à des bases de données lexicales. Bien qu’elles constituent un apport considérable pour le domaine, les ressources existantes souffrent de plusieurs insuffisances. D’une (...) part, elles s’appuient sur des corpus de référence peu représentatifs du lexique scolaire auquel les élèves sont exposés au primaire, et d’autre part, elles ne permettent pas aux utilisateurs de déterminer la façon dont se développe l’acquisition de l’orthographe lexicale. À la lumière de ces constats, nous avons élaboré une ressource lexicale hybride, rendant compte à la fois de la fréquence et des caractéristiques linguistiques du lexique scolaire présent dans les manuels du primaire au Québec et, pour une partie des mots de ce lexique, de la capacité des élèves à les orthographier à chaque niveau du primaire. Dans cet article, nous revenons dans un premier temps sur la méthodologie d’élaboration de cette nouvelle base de données - nommée ÉQOL - dotée d’une Échelle Québécoise d’acquisition de l’Orthographe Lexicale, à l’origine de la création de la base de données. Dans un deuxième temps, nous évaluons l’apport de cet outil. La comparaison de notre base de données (Stanké, Royle, Rezzonico, Moreau, Dumais & Le Mené 2018) à des outils existants (trois bases de données et une échelle d’acquisition lexicale) témoigne de la pertinence de la création d’un outil propre au lexique scolaire adressé aux élèves du primaire et de la nécessité d’utiliser une nouvelle échelle d’acquisition de l’orthographe lexicale, spécifique aux compétences orthographiques des élèves québécois.
